NB:

  1. If the Retail and Commercial Leases Act 1995 does not apply, the Landlord can pass the abovementioned costs on to the Tenant (unless otherwise agreed).
  2. If the Retail and Commercial Leases Act 1995 does apply then the Landlord can only pass on half of the costs relating to the Memorandum of Lease, the Extension of Lease and production and consent costs of the Mortgagee of the Landlord.
  3. The above fee structure does not include title or company search fees. These will be charged separately.
  4. Lands Titles Office registration fee is $148.00 (current as at April 2014) and is increased annually on 1 July.
  5. Mortgagee consent fees vary from $150.00 to $450.00 (approximately).
  6. Mortgagee production fees vary from $50.00 to $250.00 (approximately).
